Wanna get out of your Cingular plan without a penalty? We may know a way

Are you stuck in a Cingular contract, want to get out of it, but don’t want to pay cancellation penalty? This part of Cingular’s Terms of Service may be just what you need.

IF WE INCREASE THE PRICE OF ANY OF THE SERVICES TO WHICH YOU SUBSCRIBE… YOU MAY TERMINATE THIS AGREEMENT WITHOUT PAYING AN EARLY TERMINATION FEE… PROVIDED YOUR NOTICE OF TERMINATION IS DELIVERED TO US WITHIN THIRTY (30) DAYS AFTER THE FIRST BILL REFLECTING THE CHANGE.

The Consumerist is reporting that the five cent text message hike from $.10 to $.15 is all you will need to escape your contract without an early termination fee.

The text message rate change is effective Jan 21, 2007. You have 30 days from then to break the contract. The change affects all postpaid and Pick-Your-Plan customers not currently subscribed to an SMS package.

The Consumerist says that Cingular will try to keep you signed up as a custmer, however, you are entitled to the cancellation. “Ask for a supervisor. Escalate. Don’t get off the phone. If they say, let me call you back, say, no thanks, I’ll hold. When they argue with you, simply restate your demand and reason. Repeat as many times as necessary.”

It works. Business end user support was more than happy to terminate my contract with no ETF effective 5 min ago.
