RIM & NTP Dispute is Maiking it Easier for Microsoft and other Competitors

Research in Motion is undoubtedly the leader in the mobile wireless email industry but unresolved settlement specifics with NTP could make it easier for Microsoft and RIM’s other competitors to get a toehold in the space.  Companies like Turner Broadcasting has thousands of it’s users on the BlackBerry platform but has put a contingency plan in place to move to other mobile email technology in case the stay on the injunction that, would prevent Research in Motion from selling BlackBerry devices and service in the United States, is removed.

A shutdown of Research in Motion is far from certain at this point but the reality is, I.T. shops only like to deal with vendors that they are certain will be around for the long haul.  The renewed legal uncertainty will definitely make I.T. managers look at alternative technologies from the likes of Microsoft, with their Messaging & Security Feature Pack for Windows Mobile 5.0, and other RIM competitors like Good Technology, who has already struck a patent alliance with NTP.

Research in Motion and NTP are at it again

Well, it looks like the $450 million patent dispute settlement didn’t actually settle things between Research in Motion and NTP, the Virginia based holding firm that owns several patents on “Push” mobile email technology.  The two companies had been entrenched for years in a heated patent infringement battle which was settled in March of this year to the tune of $450 million.  It seems like now the two companies can’t agree upon what they agreed upon earlier. 

RIM, which helped popularise mobile e-mailing with its thumb-operated BlackBerry, said on Thursday it has asked a U.S. court to enforce the terms of the deal the two firms announced in March because NTP “refuses to honour all of its obligations.”

Research in Motion settles with NTP for $450 million

Today, Research in Motion announced a $450 million dollar settlement with NTP, a Virginia based patent holding firm with several patents around wireless email technology, that resolves all current and future litigation and grants RIM and its customers the right to continue with its BlackBerry-related business and licenses RIM on all passed, present and future NTP patents.

RIM will pay to NTP US$450 million in final and full settlement of all claims to date against RIM, as well as for a perpetual, fully-paid up license going forward. The amount relates primarily to settlement of past damages, and includes the judgment and money escrowed to date totalling US$137 million (the US$152 million previously accrued included approximately US$15 million in other litigation related fees). It is expected that a substantial portion of the US$313 million, which is the balance of the settlement amount, will be expensed in the fourth quarter, ended February 26, 2005.

Shares in RIM soar as settlement talks with NTP get under way

Shares of Research in Motion (RIMM) shot over 10% higher in the passed two days on speculation that the Ontario, CA based company will settle its patent infringement dispute with Virginia based NTP. The two companies that have been entrenched in a legal battle for several years met in front of a US judge for a settlement conference last Friday. Rumor has it that these settlement talks may have been spurred on by license agreements between NTP and Good Technology, one of RIM’s biggest competitors. In January, counsel for Research in Motion stated that RIM would not settle with NTP and was prepared to take it all the way to the Supreme Court.

Research In Motion rivals NTP, Good Technology strike patent alliance

TORONTO (CP) – California-based Good Technology Inc. said Friday it has agreed to licence five patents from NTP Inc., the U.S. company that claims the rights to key technology used in Research In Motion’s BlackBerry products.

Good Technology offers “always on” push email communication services that competes with BlackBerry but offers their services on a variety of handset models by different manufacturers. NTP is the Virginia based holding company that currently is entangled in a legal battle with Research in Motion, claiming that RIM has infringed on several patents around remote email technology that they hold.

RIM won’t settle with NTP

Even though Ontario, CA based Research in Motion has already lost their patent infringement case with Virginia based holding company NTP, they have no plans to settle. In 2001 NTP claimed that RIM infringed upon several of their patents around push email technology and eventually was awarded 54$ million in damages and an injunction preventing RIM from selling there BlackBerry Handhelds and Services in the United States. That injunction was stayed and a higher court actually overturned the $54 million in damages but did uphold that RIM infringed upon 11 of 16 patents held by NTP.

Henry Bunsow, an attorney representing Research in Motion, said the company would not settle out of court and is prepared to argue before the U.S. high court.

Palm Pre Now Available Online

Even though the Palm Pre has been available for well over a month, believe it or not, you were not able to order the device online.  That was the case, at least, until today, as the Palm Pre is now available through Sprint’s website.

The Pre will cost you $199.99 on a 2-year contract after a $100 mail-in rebate.  You still are going to have to shell out 300 bucks up front to get yourself one.  This is kind of unfortunate seeing how the Pre’s biggest competitors, the iPhone and the BlackBerry, can be yours for $100 or more less out the door.  At least those who still really want a Pre will probably be able to get one.

Sprint BlackBerry Pearl Will Have Sprint TV

If you take a look at the Sprint BlackBerry Pearl spec sheet you will notice that Sprint TV is one of the exclusive applications that will be offered on the device. Sprint TV is one of Sprint’s Power Entertainment options that allows you to watch live TV with full motion video on your mobile device.

I’ve always thought that streaming video on a BlackBerry would be a huge hit in a consumer model and I hope that the Verizon model of the BlackBerry 8130 has V Cast. I will so be signing up for ESPN MobileTV if they do.

I know that Mobile ESPN failed miserably, however, I believe that it was because people didn’t want to buy devices specifically for ESPN, but, rather a service available to them on their existing media phones.

RIM Is Going To Restate Results

We’re still waiting for the press release to show up on RIM’s site, however, I just heard on Squawk Box that BlackBerry maker, Research in Motion, is going to restate financial statements going back as far as 2004 because of erroneous stock option grant reporting that could lower RIM’s earning by a quarter billion dollars.

That’s a lot of money. It isn’t “settle with NTP money”, but still, a lot of money. It will be interesting to see what RIM (RIMM) does in the markets today.
