BlackBerry maker Research in Motion has sued Samsung, maker of the BlackJack, a new mobile device with arguably the coolest commercial for a smartphone, for trademark infringement in US Federal Court in Los Angeles last week. RIM thinks that the name BlackJack is so similar to BlackBerry that it could confuse consumers actually looking for a BlackBerry.
I figured that it was just a matter of time before this happened. One of our RIMarkable readers mom mistakenly bought him a BlackJack for Christmas thinking it was the BlackBerry Pearl.

Well, I can see why RIM is doing this. I’ve found a few webpages, and this is my
favorite one. It lists all the specs for the pearl, and then at the bottom, shows
two giant pictures of the Blackjack.

Hmmm, you just survived a lawsuit that dang near put you out of business and now you want to launch a frivilous lawsuit over a dumb name???
Get real…no one will confuse the BlackJack with the BlackBerry Pearl unless the sales rep does it for them…

True, but the fact remains that to a first time smartphone buying consumer the similar name on a similar device could cause confusion.
